Why you oppose to others’ trademark registration?

Prevent it from being registered if the trademark is stolen from you or similar to your well-known trademark and will confuse your customers when they decide what to buy.

What requires to file?

1. The notice of opposition is filed on Form T6;
2. A statement of the grounds of opposition
3. The opponent, at the same time as he files the notice of opposition, shall send a copy of it to the applicant

Content of the statement of grounds of opposition

There is no prescribed form that the statement of grounds must take. It can be in the form of a declaration, notice or letter.

It should set out the primary facts upon which the opposition is based, and if based upon an earlier mark, the following particulars are required:

1、a representation of that earlier trademark

2、if it is registered in Hong Kong, a statement of the goods or services in respect of which it is registered OR a statement indicating the registration or application number(s) of the earlier trademark(s) where there are registration(s) or pending applications in Hong Kong.

3、if it is not registered in Hong Kong, a statement of the goods or services in respect of which it is used.

1. The opponent file
2. Acknowledgement
3. The applicant counter-statement( within 3months)
4. Evidence period(file evidence by way of statutory declaration or an affidavit)
5. Hearing
6. Adjudication
